Analysis of the influence of amendments to the legal provisions relating to building structures on keeping the real estate cadastral database updated

key words: status of the building, outline of the building, built-up area, floor area, cadastre, update of the database

Summary:

This study will analyze the amendments to the legal provisions which refer to the entering of building structures into the real estate cadastre, contained in the Regulation on the register of land and buildings, introduced during the subsequent amendments, that is in 2013 and in 2015, with respect to the original text of 2001. This will form the background for the issue of a partial loss of the updated status of the database for the building records therein entered under the previous wording of the Regulation on the register of land and buildings, becoming effective as of the day the next amendment to the Regulation comes into force.
The effects of these amendments will be analyzed, some of which should be considered positive, as the new provisions clarified the previous formulations, which remained unclear and gave rise to ambiguous interpretation of cadastral data of buildings. However, another part of the amended provisions makes the essential cadastral data of the buildings which are entered into the real estate cadastre outdated, despite no changes made in their construction. These essential data include, for example, status of the building or contour of the building, and the resulting built-up area.
